Terms of Service

These terms apply to tiva-digital.com, the TIVA Digital client portal, and the services we provide. By using them you agree to these terms.

Our services

We design, build, host and look after business software. What we deliver for each client, its price and its timeline are set out in a separate proposal or invoice, which takes priority over these terms where they differ.

Using this website

Our contact form is protected by Google reCAPTCHA. By sending it you also agree to Google's Terms of Service and Privacy Policy. Do not send automated or bulk messages through it.

Portal accounts

• Accounts are created by us for our clients and their staff. Keep your password private; you are responsible for activity under your account.
• Use the portal only for your own business's records. Do not try to reach other clients' data, disrupt the service or get around its security.
• We may suspend an account that breaks these terms or puts the service at risk.

Fees and payment

Invoices are payable within the terms shown on each invoice. Recurring services (such as hosting or care plans) renew at the end of each period unless cancelled before the renewal date. Prices include or exclude tax as shown on the invoice.

Your data and ownership

The business data you put into an app we build for you remains yours. Once paid for in full, the custom app built for you is yours to keep, as agreed in your proposal. We keep the right to reuse our general tools, know-how and building blocks in other work.

Availability and backups

We work to keep the service running and take regular backups, but no online service can be guaranteed to be available at all times or error-free. Planned maintenance will be kept short and announced where possible.

Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses (such as lost profits), and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim.

Ending the service

Either side may end a recurring service with notice before its next renewal date. On request, we will provide an export of your data before an account is closed.

Changes

We may update these terms; the date above shows the latest version. Continuing to use the service after a change means you accept it.

Governing law

These terms are governed by the laws of India, and disputes are subject to the courts where TIVA Digital is registered.
